This session will review how the various kinds of errors and omissions policies for producers work or sometimes don't work. The presenters will look at five real-world situations involving litigation, then apply key provisions and exclusions that in most cases would result in a denial of coverage for the producer. They will include as one of these situations the Nesham case, the elder abuse case from California involving an indexed annuity where the agent was sentenced to prison. As part of the presentation, speakers will examine how small changes in procedure, documentation or business practice could have yielded a different result.
